Real Estate Conveyancing & Mortgages

Conveyancing is the transfer of legal title of property from one person to another or the granting of an encumbrance (a claim or liability against real estate) such as a mortgage or a lien—a public record and security for parties.
A typical conveyancing transaction contains two major stages: the exchange of contracts (whereby equitable title passes) and completion (whereby legal title passes). For mortgages it is where pledging of your equity or title is completed.
This is where dks Legal & Notary Services helps. During the conveyancing or mortgage process, the contract and the title will be examined along with any charges or mortgage instructions (if any) to determine exactly what needs your file has. A statement of Adjustments and/or Order to Pay will be prepared along with all other ancillary documents. Undertakings will be exchanged between the legal offices to have charges removed or a mortgage filed on the property as per the agreement. Your appointment will be set at a mutually convenient time. You will be advised how much money to bring in via a certified cheque and/or to pick up your net sale or mortgage proceeds, depending on the transaction. Exchange of title, money and reporting will happen on the completion of the conveyance and/ or mortgage funding date. The team will manage and direct you through the process.

ID Requirements
You will be asked to provide two pieces of identification, one of which must be government-issued such as a Driver’s Licence, BC Identification, Passport or Permanent Resident Card. It is critical that the names must match on the identification AND your documents. Please call prior to your appointment if this is not the case. Note: a combined Drivers’ Licence and Medical card only count as one piece of identification.
